Overview

Eswatini spans subtropical highland to lowland savannas. Approximately ~10.3% of land is arable, supporting sugarcane, citrus, maize, pineapples, and timber/woodlots. Major imports include maize, wheat, and rice/sugar; major agricultural exports are citrus, sugar products, ethanol, and wood products. Eswatini Biosafety Act, 2012, provides mechanisms for ensuring the safe handling, transfer and use of products of biotechnology. It applies to the import, export, transit, contained use, release or placing on the market- (a) of any GMO whether intended for release into the environment, for use as a pharmaceutical, for food, feed or processing; (b) or a product of a GMO, except for pharmaceuticals subject to the Pharmacy Act, 1929. Eswatini Environment Authority is designated as the Competent Authority for the purpose of implementation and the administration of this Act and any regulations made pursuant to the Act. A National Biosafety Advisory Committee is established for the purpose of conducting risk assessments and providing scientific and other technical advice and assistance to the Competent Authority.

Importation Regulatory Snapshot for
GM Food, Feed, or for Processing

Application Process for GM FFP
Import Permit

  1. A letter of intent to import GMO-FFPs is lodged with the registrar and an application form is issued to the applicant.
  2. The application will require information including identification of the importer, description of the GM product, quantity, expected date of arrival and entry port, evidence of approval of GM product by the competent authority in the exporting country, summary of risk assessment report, methods and plans for safe handling, storage, transport, and use, including packaging, labelling, documentation, disposal and contingency procedures.
  3. On determination of completeness of the application, the applicant is required to publish a public notification for a period of 28 days to allow public comments to be considered during the review process.
  4. The NBAC reviews the application including the risk assessment data and makes recommendations to the SEA which ultimately makes the final decision.
  5. Application decision is made within 120 days for a first-time application. However subsequent application for the same product is subjected to the “Simplified Application Procedures” with a turnaround time of up to 7 days.
  6.   The permit is valid for 3-months. Renewing an application is subjected to the Simplified Application Procedures.

Permit Fees

  • For importation the fees charged for import permit is 550 SZL.
