Overview

Zambia spans plateau savannas from subtropical highlands to lowland. Approximately ~5.1% of land is arable, supporting maize, soybean, wheat, cassava, sugarcane, groundnuts, and horticulture. Major imports include wheat, rice, and vegetable oils; major agricultural exports include tobacco and sugar, with maize exported in surplus years. No GM crops are commercially cultivated; however, imports of products that may contain GM are permitted under the Biosafety Act (2007) for food, feed, and processing (FFP).

Zambia’s biosafety framework centers on the Biotechnology and Biosafety Policy of 2003, which outlines the country’s overarching approach to biotechnology, including biosafety considerations; the Biosafety Act No. 10 of 2007, which regulates research, development, contained use, intentional release, import, export, transit, and commercialization of GMOs and their products, ensuring the protection of human and animal health, biodiversity, environment, non-GM crops, and socio-economic interests; and the Statutory Instrument no 42 of 2011 on Food Feed and Processing. The Act established the National Biosafety Authority (NBA), supported by a Scientific Advisory Committee, tasked with conducting risk assessments, issuing permits, enforcing compliance, and facilitating public participation through newspaper notifications and consultation periods. The Act mandates risk assessment, management protocols, labeling, liability, and co-existence strategies. Institutional Biosafety Committees at research bodies ensure contained use oversight.

Importation Regulatory Snapshot for
GM Food, Feed, or for Processing

Application Process for GM FFP
Import Permit

  1. First step is to fill the application (Form I) obtained from NBA providing the relevant information necessary for the application to be reviewed. Key requirements include  identity of the entity seeking permit to import GM product, description of the GM product and purpose for which the GM product will be used, country of origin and evidence that it has been approved for commercialization there, scientific publication related to the GM product, process for monitoring and waste disposal, indication whether a permit or license for GM related activity has previously been issued to the applicant in Zambia. Additional documentation includes evidence of public liability insurance among other documentations as per the application form.
  2. Application will be reviewed for completeness within 14 days and applicant notified for completeness (Form II) or defectiveness (Form III) or additional information required (Form IV).
  3. Authority forwards the application to the Scientific Advisory Committee and either the Plant Quarantine and Phytosanitary (plant commodities) or Veterinary service (non-plant organisms) for technical advisory opinion within 30 days from the time they receive the application.
  4. On approval of application applicants are required to notify the public within 15 days after acceptance of application through an advert published in a newspaper with nation-wide coverage and present evidence of the same.
  5. Tracking of the process is done through the paperwork documented and recorded in the registrar.
  6. The Authority commutates decision made through specific forms – successful applicant (Form II) and rejection (Form VI) but can re-apply. Applicant can appeal an unfavourable decision through the Appeals Tribunal (Form XI).
  7. The Minister is the licensing authority responsible for the granting, renewal, variation, suspension and revocation of licences. Permit is issued through Form V.
  8. Permit is valid for 5 years and may be renewed for a further period of 5 years. 

Permit Fees

  • Zambia charges K5,040 per event as well as cost of risk assessment evaluation and K15,000 for placing on the market and renewal of permit.
